ALLEGATION 4
That Councillor Penhalluriack victimised the CEO for making a complaint against him. This conduct has damaged the CEO’s reputation and standing, undermined the CEO and his staff in their employment and has caused the CEO stress, harm and hurt feelings.
| 30 Nov 2010 | At an audio taped Council Meeting, Councillor Penhalluriack criticised the CEO for not accepting mediation. This was in respect of informal complaints made by the CEO to the then Mayor. The CEO referred to the obligations of his employer and that if he wanted to raise the issue he would do so with his employer, the Council. |
| 2 April 2011 | Councillor Penhalluriack writes a letter to Mayor Esakoff in which he strongly criticises the CEO, Peter Jones, the MRC and the CRRT. With respect to the allegations of inappropriate conduct made against him by the CEO, he refers to the allegations as “something manufactured by the CEO” and “we need to take his concerns seriously, but this is the third time he has cried wolf, and I’m pleased we decided to leave him alone in the forest”. |

Jesus how unlucky can we be electing so many bullies year after year that take it out on poor ol defenceless Andy. Would have thought that lightning only strikes once in a place. Not in Glen Eira and not when Andy is at the helm.

O”Neill, the Ombudsman, and the Council all have a huge problem with Frank’s shocking behaviour towards the CEO. This matter is now before the Judiciary and no matter how hard you try to rewrite history this is out of our hands.

A tick to the Council for consulting. Maybe they are at long last getting the message. Oh! That’s right it’s is election year isn’t it.
All look fine to me. Probably lean to the mixed use.
Just so glad to have that unsightly piece of land put to some useful purpose.

yes you would think they would take notice of the consultation wouldnt you but have a look at the one on Packer Park. Lots of calls for a kindergarten but they have just gone with what they will wanted and the Carnegie Primary school has been forced to allow the kindergarten to use some of their grounds.

I’m struggling to accept that on the basis of two incidents O’Neill decides to apply the word “victimisation”. I wouldn’t have thought that Penhalluriack has any power to “victimise” a CEO simply because he’s asking questions and seeking reliable and full answers. He is also not wrong in saying that this isn’t the first time that Newton has pulled the bully trick on councillors who don’t toe the line in accordance with his wishes.

Speaking of bullying… then there seems to be something strange about all the photographs of our elected councillors over the last twelve years or so…. The newcomers seem to always leave.. is there some reason why they have felt uncomfortable??? or is it just co-incidence???
One thing it seems there seems to be no apparent democracy at council meetings… authentic debates in the chamber do not take place but contrasting views are simply stiffled, whether it be by points of order or forming a select committee of four to make world shattering decisions (like C60 and the Centre of Racecourse) and thereby ommitting to include the views of the majority of cocuncillors. The whole arrangement reflects a dictatorship with a few councillors performing the charade at council meetings apart from Cr Frank Penhalluariack who really tries, usually, unsuccessfully to submit an alternative view.

All of these allegations all seem to point to one thing. It’s totally verboten to criticise no matter how well deserved these criticisms are. That really means that these fat cats are like sacred cows – untouchable. They get paid by Newton, assessed by Newton, and rewarded by further contracts by Newton. There’s no reason why they should not do exactly what he wants. Their jobs depend on him. The biggest joke of all time is that he does the performance assessment and no one knows the results of these. I really wonder how Akehurst and his planning department would go in a real well run council.

To Autonomy, oh! council always consult so as we think we are making a worthwhile contribution, in actual fact this is simply for show.
At one of community consultation meetings the CEO spent much of the night talking and not listening to the poor famillies of Ormond who told of water flowing several times through the front and back doors of their homes.
The officers organised the meetings but the CEO DID NOT EVEN BOTHER TO LISTEN JUST CHATTED ON!!!!!!
