Rudd quickly got rid of Lake for his personal abuse. That aspirant had the good grace to apologise. Doubt if Hyams has the same integrity. Will be good if the libs follow the same route.

Nick Staikos Labor Candidate for Bentleigh may well be in a spot bother when the Auditor-General tables his report into the Caulfield Racecourse board of Trustees. Mr Andrews may have to find a new candidate for Bentleigh.

Hyams is a total disgrace and a Councillor that stirs sh***. Before swearing at the resident, did he not think how he would feel if the word ‘Bitch’ was used on one of his family members i.e. sisters, mother or grand mother? Only a SICK person will insult people in the public? Has this been reported to the Municipal Inspectors and the Victorian Ombudsman?

I think this is a very series matter. “you are a negative whining bitch” can be heard very clearly. Not only has Cr Hyams lied to Council he lied to the people who voted for him at the last election. The residences of Glen Eira can never trust him again. Question: Have all 9 councillors heard this recording?

Nothing wrong with speaking ones mind. Did he hurt her feelings? This is politics. It is distasteful, mean, dirty and often bad. Still beats the alternative as is seen in Iraq today. He has broken no law. Peoples actions speak for themselves and they are seen for what they are. I doubt that he is the first councillor to have a go at a resident. and he won’t be the last.

It may well be politics as you like to think but that’s not a reason to slide into the gutter. There is also LAW – L-A-W and telling fibs in council is not part of that law. The code of conduct is L-A-W too and that has many paragraphs devoted to treating residents with RESPECT. If Hyams can’t stand the heat of criticism then he should get out of the kitchen. He’s a public figure and criticism comes with the territory. Abusing people is not answering or rebutting the criticism and then producing porkies to cover up the abuse is ten times worse than the abuse in the first place. No politics of whatever party should get to this level of cover up and lies. If he can tell lies about this then what about the big stuff?

A simple public question. Cr Hyams have you heard the tape that has you saying “you are a negative whining bitch”, if so do you stand by the response you gave to Mrs Manaszewicz’s public question at the council’s March 18 meeting ? (From the March Meeting: Cr Hyams provided a response. He said: “You have misrepresented or misheard the words I used. I didn’t call you a bitch. I used the word as a verb to the effect that you just bitch. It is possible I also used the word whine and said you whine and bitch, but I don’t think so.)

Accolades to him for sticking up for resident past, presnet and future. General statements about people living peacefully are fraught to fail on a individual basis, as we see from time to time in our community.

You must be a close relative to Lobo because I do not understand what on earth you are saying. But on India, it has recently displayed a sexist racist culture that we do not want in Australia. We should not approve of Australian Muslims fighting in wars in Iraq and Syria, Australian Jews fighting in Israel or Indians condoning rape. That is my view. Thank you to a free Australia.

I have listened to the tape and Hyams insults are clear. Calling someone a bitch isn’t a hanging offence by itself. Lying about it is another matter all together.
I think he has been pretty stupid when a simple apology could have ended it. Council has to do something about this. Otherwise they are just showing everyone that they don’t care what a councillor says or does and that residents are there to be insulted and abused whenever the likes of Hyams decides to spit the dummy. I can’t help thinking that if this was Penhalluriack then all hell would break lose.

This is an honesty and integrity test for councillors. If they’ve heard the tape then they have to act with disciplinary action against Hyams. All they did was take Hyams word for it before and this shows how much his word should be relied on.

If you refer to the online Leader article and council minutes you will find that Hyams admits to using this language – but as a verb, rather than a noun!!!! The tape we suggest reveals the untruth of this ‘excuse’. Further, if anyone has ever attended council meetings, or spoken with this councillor, then the voice on the tape is 100% that of this councillor!

The unsavoury incident occured in front of another resident hence the explanation “that was your ex-mayor”. It’s Council’s handling of the matter that has been appalling though. Remember it is *their* Code of Conduct that specifies amongst other things that they must treat all persons with respect. Instead what happened is that the Mayor permitted Cr Hyams to respond as Council’s representative and say that his comments were appropriate to which he added further insults. At least he admitted he didn’t remember what he said but somehow attempted to suggest he didn’t say what the tape clearly captures.
Council has studiously avoided mentioning their Code of Conduct, so to refresh their memories: LGA defines misconduct by a Councillor to mean “conduct by a Councillor that is in breach of the Councillor Code of Conduct”. Council should inform us whether “negative whining bitch” is being respectful, or is a breach of the Respect provision. There may be additional breachs by now, involving Integrity and Honesty.

Cr Hyams clearly said “There is no conflict of interest in Council. You’re such a negative whining bitch seriously” This is not consistent with his response to the public question at the council’s March 18 council meeting. Glen Eira Council needs to address this if residences are to have any trust in Councillors again. By keeping quite all Councillors are condoning Cr Hyams appalling behaviour.

If the resident wants to take this further there needs to be another letter to all Councillors at the next Council meeting asking them individual have they heard the tape and do they think Cr Hyams response on the 18th off March is consistent with what they here on the tape. Eight councillors need to stand up against this sort of bullying and intimidation.

I don’t think it’s the residents job to take this further. It’s council’s task. Public questions were asked and according to one there was no follow up from council or councillors to even try and verify what was claimed by the resident. Plus council heavies are sure to be monitoring this site so the ball is firmly in their court.
The minutes also have Delahunty and Lobo disapproving of the answers and the latter advising action. What or who is stopping them?
