We’ve been sent a video of a construction site in Bentleigh East that would seem to have no regard for neighbours’ amenity, nor the law. No work is permitted prior to 7am weekdays, yet this video was taken at 6.15 am, several weeks ago. Please note the noise. Council does have the authority to fine and even to stop the work. Will they go to this extent? Or is the developer and his contractors more ‘important’ than local residents?

Handing out fines of a few hundred dollars isn’t going to work. They don’t care and its probably a tax deduction anyway. What would make then obey the law is to stop them with an order for a couple of weeks and then see what good citizens they become.

Wrong. The council sticks to its long term strategic plans and its GE Planning Scheme designed to satisfy its strategies and objectives. Developers follow closely the rules and negotiate to achieve the best result for themselves. You do not want to fight with the Council, but you develop plans to satisfy Council objectives and within the State government allowable rules. Is there anything wrong with that? There is no requirement to satisfy a concoction of community or individuals wishes.

There certainly is a “requirement to satisfy” council’s local laws and probably a few state laws as well. If these laws are ignored then it is council’s responsibility to ensure that they are enforced. As for the “concoction of community or individuals wishes” I wouldn’t think that requiring builders to start when they are legally allowed to, or respecting other people’s environment and peace and quiet is asking too much.

The protection of residential amenity is notoriously weak in Glen Eira. Unlike many other Councils, GECC doesn’t have a local law to cover hours of building construction activity. Still, Part VIII of the Environment Protection Act and the Environment Protection (Residential Noise) Regulations; and the nuisance provisions of the Public Health and Wellbeing Act apply. Although Council says you can contact them, it is very unlikely they’ll answer the phone at 6am. Contacting Caulfield police is another possibility for out-of-hours nuisances.
