The code of conduct is relevant in this context of Hyams writing to the Leader. It says “save where otherwise agreed, the Mayor, or in the absence of
the Mayor, the Deputy Mayor and the Chief Executive Officer or
nominee are the designated persons authorised to speak to the
media and others on behalf of the Council”. Hyams obviously believes he is above any law which would restrict his propaganda.
The code does not say that councillors cannot speak to the media. Delahunty is on the radio all the time. Nothing wrong with that. No laws broken here.
The VCAT decision to grant a permit was made ages ago. Then the MRC put in an amended application which was later withdrawn. Thus, we assume the original permit is what has now been implemented.
Amazing to learn that the MRC tenants are continueing to clutter the parkland with electronic garbage, surprising since the Minister called for serious changes! In passing we attended the Cup week Wednesday and did not see the towers.. nor the race horses because of the big screen. There seems to be little point in attending as the pictures on the screen show only partial views of the race whilst managing to effectively block out any view of the real thing and screening of advertisements in the central part of the screen even promoting an ice cream product. We’ed recommend local hotels for a better view of the races.
Cr Hyams is having a lend of us, yet again. Council didn’t negotiate with the State Government—negotiations took place with Cr Hyams, Andrew Newton and Jeff Akehurst [without delegated authority to do so]. Mandatory height limits were not imposed on land zoned MUZ, which the State Government defines as Residential. The changes to the purposes, as-of-right uses, decision guidelines, and neighbourhood character criteria resulting from the new zones, in particular RGZ, were not an outcome of the 2010 planning review. The recommendation from the review, which Council adopted, was essentially to complete the review “in-house”. The public was not presented with, and could not comment upon, any specific changes to the Scheme.
In once sense Council never took action, other than to remain mute while Cr Hyams did as he wanted without public scrutiny. Remember that decisions made in Assembly of Councillors are NOT Council decisions. Council has never published a resolution that would give Cr Hyams or senior council officers the authority to behave as they did. Somebody asked the Minister to use his extraordinary powers to make changes to the Glen Eira Planning Scheme and the Minister did as he was asked. The Minister used the legal fiction that he prepared the changes, although they were actually done by council staff [but publicly denied by Cr Hyams on behalf of Council].
We have 4 incumbent councillors who participated in this charade: Crs Hyams, Magee, Esakoff, Delahunty. Cr Delahunty was aggrieved but still went along with it. We saw with the demise of the Conservatory that Cr Delahunty doesn’t truly believe in community consultation, so maybe her position was simply a manifestation of party politics.
One extraordinary note from a meeting with the Minister and Department is the following: “Council has concern about where it is going”. If they have concerns, they’re not sharing them with ratepayers. Another note states: “Council believes it does not need to go to Council for a resolution because it is converting policy to the zones”. That cannot possibly be the view of Council without a resolution, but may well be the view of Cr Hyams. As many of us are well aware, the changes were far from neutral and have not been satisfactorily justified.
Reprobate – We can comment/complaint as much as we can talk and to use Hyams words in one of the public council meeting on developments “Resident’s can complaint about the zones until the cows come home” Maggee further went to state on radio that the zones are here to stay and residents can get stuffed. Residents who were irritated and still are, have now voted for Hyams, Maggee and Delahunty. WHAT CAN BE SAID OF THE RESIDENTS NOW; ARE WE NOT ALL DUMB AND DUMBER. WE ARE AND WE WILL REMAIN DUMB EVER AFTER. HELP NO ONE ALMIGHTY AS NONE OF US DESERVE GOOD FROM THE COUNCIL.
“excessive migration” your words not mine, is the growth model that both major parties are locked into lock stock and barrel. The big end of town love it because it keep them in the high end suburbs away from the plebs, affords them luxury imported cars and private schools.
We need to scope out alternatives to this idea of growth at all costs. It well worth Googling and thinking about
The main source immigration is through the Monash Immigration Centre (AKA Monash Uni) Foreign students sign up and the dumb bastards working at Monash think it is because of their high standards. Got nothing bto do with it. It is all about PR. (Perm Residence) Of course it employs lots of lecturers. Senior staff operate road shows to China and India openly promoting the possibility of immigration once you graduate. They use this as the hook. It works. Walk up Koornang Rd and you will see the success. It no doubt is the main driver behind development in Carnegie.
Too bad they are prepared to buy and live in dog boxes.
In terms of having an impact on planning Staikos is stuck up that well known creek in a barb wire canoe with a broken paddle. He cannot and will not do anything.
Official swearing in of the new (and old) group tonight. Assume they will elect the Mayor too. If it’s one of the old brigade it’s the first sign nothing has changed.
